Giveaway Terms & Conditions 

Promoter: The promoter is nimbl Ltd of 2 Leman Street, London, E1 8FA, United Kingdom (hereinafter "Company"). 

Prize Offer: The prize offered is one console a week where the prize will alternate between an Xbox Series S or a Nintendo Switch. No cash or alternative is available. The promoter reserves the right to change the prize as may be required by availability. 

Promotional Period: The nimbl Summer Boredom Buster Giveaway promotion ("Promotion") runs from 1 July 2024 to 25th August 2024 ("Promotion Period"). During this period, there will be eight (8) prize periods of 7 days each. 

The giveaway entry time is Monday to Sunday. The winner will be selected on the following Monday. The prize periods are as follows: 

Eligibility: A purchase of an annual subscription to the nimbl card and app is required to enter the promotion. Each weekly prize offer is open to all new, annual subscription Child Accounts (known as the “New Users”), whose account was opened within the specified 7-day prize period. Users are required to reside at a UK address. Employees of nimbl Ltd or its parent company Caxton Payments, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Promotion. 

How to Enter: Users who have met the criteria of the giveaway will be entered into a prize pool. Your entry will be automatically counted when the annual fee is taken, after a successful application.  

By signing up for nimbl through Affiliate links, applicants will be deemed to be bound and have accepted these promotional Terms and Conditions in addition to the standard nimbl Terms and Conditions. 

Winner Selection and Notification: One winner will be selected in a random draw from among all eligible entries received during each prize period. The company, acting reasonably, will attempt to contact the potential winners via telephone or email within five (5) business days following each draw. If a potential winner cannot be contacted within five (5) business days after the draw, or if they are disqualified for any reason, an alternate winner will be selected in a random draw from the remaining eligible entries. Proof of identification must be provided upon request before the prize is awarded. 

Winner Social Media: Winners of the prize agree to take a photograph with the prize for the purpose of using on nimbl social media, email and website communications 

Release: By submitting an entry into the promotion, each participant and winner waives any and all claims of liability against the Company and its employees, for any personal injury or loss which may occur from the conduct of, or participation in, the promotion, or from the use of any prize. 

Decisions: The Company reserves the right to disqualify any participant and may refuse to award any offer to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the offer, or obtained the offer using fraudulent means. Further, the Company will resolve any disputes, conflicting claims or ambiguities concerning the rules and the Promoter’s decisions concerning such disputes shall be final. All decisions will be made by the Promoter and are final. The Company may waive any of these rules in its sole discretion. 

Right to Cancel: The Company reserves the right to cancel or amend the promotion and these terms and conditions without notice at any time without any obligation to compensate for any damages on behalf of the participant. Any changes to the competition will be notified to participants as soon as possible by the Company. 

Miscellaneous: This promotion is in no way affiliated with Microsoft Corporation, Inc. or Xbox. This promotion is in no way sponsored, administered, or associated with Pokémon, Nintendo® or Nintendo Switch™. 

Governing law: These Terms and Conditions are to be interpreted in accordance with English law and any dispute arising out of these Terms or their subject matter is subject to the exclusive jurisdiction of the English Courts. 

Data Protection: Applicants’ personal details will at all times be kept confidential and in accordance with GDPR and the nimbl Privacy Policy
